This website and related services are operated by MIBON, operated by SKTK AUS Pty Ltd ("MIBON", "we", "us" or "our"). These Terms of Service apply when you access or use mibonmode.com, purchase retail products from us, or book services through our website or integrated booking channels.

By using the website, purchasing a product, or making a booking, you agree to these Terms and any policies referred to in them, including our Privacy Policy and Returns & Exchanges Policy.

1. ONLINE STORE & BOOKING TERMS

You must use our website and services lawfully and must not interfere with the operation, security or availability of the website or any connected service.

Retail orders are subject to product availability and acceptance. Service appointments are subject to availability and to any deposit, rescheduling, cancellation or no-show conditions communicated when the booking is made, including conditions applied through an integrated booking platform such as Fresha.

2. PRODUCTS, SERVICES & PRICING

Prices, product descriptions, service descriptions and availability may change from time to time. We may correct genuine errors in descriptions or pricing and may withdraw products or appointment times that are no longer available.

We make reasonable efforts to display product images, colours and descriptions accurately, but appearance may vary between screens and devices.

3. ORDERS, BILLING & CUSTOMER INFORMATION

You agree to provide current and accurate information reasonably required to process your order, payment, delivery or booking. We may refuse or cancel an order where reasonably necessary, for example where stock is unavailable, payment cannot be processed, fraud is suspected, or an obvious pricing error has occurred. Any refusal or cancellation will be subject to applicable law.

4. THIRD-PARTY SERVICES

Our website and business may use or link to third-party services, including Shopify, payment providers, Google, Meta and Fresha. Those third parties may provide services under their own terms and privacy policies. We do not control separate third-party platforms and are not responsible for their independent acts or omissions except to the extent that applicable law makes us responsible.

5. INTELLECTUAL PROPERTY

Unless otherwise stated, the branding, original text, photography, graphics and other content made available by MIBON are owned by or licensed to SKTK AUS Pty Ltd. Third-party software, themes, fonts, applications, trademarks and other licensed materials remain the property of their respective owners.

You may use the website for personal, non-commercial purposes. You must not reproduce, distribute, modify or commercially exploit MIBON-owned content without permission, except where permitted by law.

6. REVIEWS, FEEDBACK & SUBMISSIONS

If you voluntarily submit a review, image, comment or other material for publication by MIBON, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that material for the purpose for which it was submitted, including reasonable promotional use. You confirm that you have the right to provide the material and that its use will not infringe another person's rights.

7. AUSTRALIAN CONSUMER LAW

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where goods or services fail to meet a consumer guarantee, the remedies available to you depend on the nature and seriousness of the failure. Our Returns & Exchanges Policy provides further information for retail products. Any store policy, booking condition or other term operates subject to your non-excludable rights under law.

8. LIABILITY

To the maximum extent permitted by law, MIBON is not responsible for loss or damage that was not caused by our breach, negligence or failure to comply with applicable law, or that results from events outside our reasonable control. Nothing in this section limits liability or remedies that cannot be excluded or limited under the Australian Consumer Law or other applicable legislation.

9. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our services, business operations or legal requirements. The current version will be published on our website with the date of the latest update where applicable.

10. GOVERNING LAW

These Terms are governed by the laws of New South Wales, Australia. You and MIBON submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts entitled to hear appeals from them.
